Accessing Medical Reports

Under section 4 of the Data Protection Acts 1988 and 2003 you may obtain a copy of the medical report furnished to your employer or insurance company following your medical assessment at Medwise.

You should put your request in writing to the individual who commissioned Medwise to prepare the report. This is normally the HR Manager in a workplace or the Health Claims Assessor in an insurance company.

The employer / insurance company has responsibility as a Data Controller under the terms of the Data Protection Act to release the report within 40 days of receiving a request in writing.

The right of access to medical information is restricted in some exceptional circumstances, where the health and mental wellbeing of an individual may be affected by obtaining access to the data. In addition, there are some other limited circumstances whereby the Data Controller may withhold information.

Similar regulations apply to public bodies under the Freedom of Information Acts 1997 and 2003.
